I run a consultancy offering dispute resolution (by mediation or arbitration) as well as DR training and system design advice. I am (for my sins) passionate about process - the way in which disputes are resolved - since this is a major factor in how satisfied (or otherwise) businesses are when disagreements need to be tackled.
These disputes can be among workers or with customers, suppliers or contractors.
They can involve legal issues, but more often than not they also (or even exclusively) involve communication, personality or perception problems.
What matters is that the right process(es) are chosen to fit the dispute, making it easier, quicker, less stressful and cheaper to resolve.
Nipping a dispute in the bud can often be important, so speed is a key factor, but other factors such as privacy, expertise in the decision-maker and influence in shaping the process can be important.
I will be presenting to the Society of Advocates next week on this subject: Dispute Resolution Advice: Factors First, Then Methods. Looking forward to hearing the views of the local legal profession in this area.
